3.II.(f)     Apply Australian common law precedent to -

               *           materially reduce Negligent Lifestyle Behaviour; and

               *           maximise Australia's 22m Human Brownfield Infrastructure's  Contribution To Society

If a driver's negligence causes a motor vehicle accident which seriously injures a third party(s), that driver is liable under Australian common law for damages suffered/costs incurred by the third party(s).  In Australia the CTP GreenSlip provides a pool of funds to cover such claims against personal negligence.

If a driver's negligence causes a motor vehicle accident which seriously injures itself, that driver has no recourse for damages to itself under common law for damages/costs.  The CTP GreenSlip in Australia is not available to compensate for a negligent driver losing say his arm or incurring spinal injuries.  The negligent driver (unless it holds personal injury cover) receives no compensation for their lost arm or spinal injury, because it was due to the driver's personal negligence to himself/herself.

If an adult damages itself through Negligent Lifestyle Behaviour, the current Australian health system will pay for some of Adverse Effects of such negligence, including Health System Costs:

(i)         alcoholism causing renal kidney failure,

(ii)        cigarette smoking causing lung cancer,

(iii)       drug addiction causing "inter alia" robbery, violence, reduced productivity, family break-up and ill health, or

(iv)       lethargy causing Obesity, Type 2 Diabetes, arthritis, back problems etc.

The fiscal pool (Section 3.II.(a)) will shortly be insufficient to meet the increasing cost of medications for a population, amidst a reducing tax payer pool, which is living much longer due to "inter alia" antibiotics, anti-cholesterol statins, anti-coagulants and blood pressure pills, as well as advances in medical technology.  Hence, Governments need to implement a cost-effective Youthful Exuberance Lifestyle Programme based on pro-actively assisting Interested Adults  Improve Personal Health & Fitness rather than Government predominantly treating the Adverse Effects of Negligent Lifestyle Behaviour

Section 3.II.(a) patently establish that due to the unprecedented projected Health Care Costs of Baby Boomers, economic necessity dictates that treating the cause of good health will need to incorporate the same common law practices for adults who damage their health due to Negligent Lifestyle Behaviour in order to maintain viable federal and state health budgets to remain competitive in a global financial market.

In short, if you damage your health due to your own negligence (ie. alcoholism, nicotine addiction, hard drugs, not maintaining a Healthy Diet, leading a Sedentary Lifestyle, Obesity/Type 2 Diabetes) State and Federal Governments will soon have no alternative but to inform their constituents that it will not pay for remedial health treatment costs due to Negligent Lifestyle Behaviour, and that if you do not have private health cover, then that is your problem.  This has applied throughout most of the world for most of its history.

A more simplistic way of viewing this problem is that each member of the community has to Contribute To Society by "paying his/her rent" to enjoy the rights of occupancy.  If some members of the community negligently impair their capacity to "pay their rent", then their rent entitlements fall away. 

Measuring Interested Adults, Contribution To Society may seem an invasion of civil rights.  But on the contrary, paying one's income tax has been a principal tenet of society since the earliest civilisations.  In most Western countries, you go to jail if you evade your income tax (contribution to society) assessed on your income (what you are taking from society).  Al Capone is alleged to have committed many nasty acts against other members of society.  However, ironically, Al Capone eventually went to jail due to, of all things, income tax evasion.

Beyond 2010 the 4 major super powers will be: China, USA, Europe and India. 

Under a global economy, all countries need to remain competitive in order to pay for their foreign imports.  A simple analogy is an "International Rowing Regatta" with all countries competing in qualifying races to progress to the "Rowing Regatta Final", whereupon qualifying will evidence their Government's treasury bond interest rates reducing due to high performance/lower risk.  Regatta teams which do not qualify for the "Rowing Regatta Final" will evidence their credit ratings decrease/higher risk, with their Government treasury bond interest rates increasing, as those countries are deemed more risky and will have to offer higher bond interest rates to attract investors.  It will cost countries that do not qualify for the "Rowing Regatta Final" more to borrow internationally through the global bond market because of substandard performance.

Continuing this analogy, notwithstanding China's ageing population due to its one child policy, two of the above super powers, China and India, will expend their fiscal pools of tax revenue on developing their fittest, young rowers.  The USA, Europe (and Australia etc) are presently committed to expend a large portion of their fiscal pool on keeping their Baby Boomers alive for as long as possible.  No amount of money will materially increase the rowing performance of such elderly rowers who live a Negligent Lifestyle, meaning such fiscal expenditure will evidence little return to GDP.  Eventually, as qualifying for the finals of this Rowing Regatta - ie. achieving a Balance of Payments on Current Account - is vital to maintaining a high credit rating for 'Sovereign Risk' and associated federal bond rates, whereupon the USA, Europe (Australia etc) will need to drastically cut their fiscal funding of the elderly as the intense competition in a global economy removes former barriers which previously enabled wealthy countries to remain partially autonomous.

Encompassed within this ethos, as a preliminary step Governments need to educate their constituents that a global economy (pressure to generate sufficient export income to pay for imports, in order to enjoy such imports, together with maintaining existing bond rates and credit ratings for governments and Corporate to borrow) dictates that a more consistent treatment of Negligent Lifestyle Behaviour, which damages their anatomy and highly correlated productivity, will need to be implemented across health services, as the fiscal  purse will  -

*           increasingly need to be expended on the young and productive; and

*           be less expended on older unproductive citizens who have previously enjoyed fiscal support during their productive years, particularly if they have led a Negligent Lifestyle

This phenomenon has flourished within the private sector across Australia's corporate sector in the last 20 years, when in many instances of dismissals where "years of faithful service have stood for naught".  Many who could no longer match it against younger employees were consigned to the scrap heap.  Economic necessity in a global economy will dictate that within 20 years this practice also applies across Australian Government health bureaucracies ie. to expend health budgets on the young and productive.  Fortunately, compared to other developed societies with large Baby Boomers, due to the minerals boom Australia will be able to delay this measure beyond when the U.S. and Western Europe have to act.

Section 3.II.(d) notes Rachelle Foreman, Director of Cardiovascular Health Programs at Australia's Heart Foundation asserting that "people over 40" need to have an annual health check with their GP.  At some point in the next 20 years, the Business Plan Developer forecasts that Government, through Medibank, will -

(i)         carry out health checks on all Australian adults;

(ii)        maintain a database on the physical health/endurance of each Australian adult; and

(iii)       impose penalties upon adults who do not Contribute To Society due to living a Negligent Lifestyle Behaviour

One problem primarily due to Negligent Lifestyle Behaviour

Dialysis is a primary treatment for people suffering acute Renal Failure Dialysis treatment costs the health care system $72,000 circa per patient p.a.  Over 2,000 Australians every day are admitted to hospital with kidney disease.  One third of all admissions to public hospitals - 2,000 patients every day, is due to Dialysis. The amount of kidney patients is growing at 8.5% pa.  The number of patients on Dialysis is increasing at 6% per annum.  Australia's health bill for treating kidney disease is growing at $1 million a week.

"Kidney failure is the seventh most frequent cause of death in Australia and exceeds road deaths, suicide, and breast cancer in number.

Diabetes and Hypertension are the primary causes of chronic Renal Failure, accounting for two-thirds of cases.

 

One cause of kidney failure is Diabetes Mellitus, characterised by high blood glucose (sugar) levels. Over time, the high levels of sugar in the blood damage the millions of tiny filtering units within each kidney leading to Renal Failure.

Around 25% of people with Diabetes develop kidney disease (diabetic nephropathy), although not all of these will progress to kidney failure.  A person with Diabetes is susceptible to nephropathy whether they use insulin or not.  The risk is related to the length of time the person has Diabetes - no cure for diabetic nephropathy, and treatment is lifelong. 

The burden of diagnosed Type 2 Diabetes in Australia is an estimated $3 billion a year, with average costs per person at $5,360 plus $5,540 in benefits, totalling $10,900.

The primary cause of Type 2 Diabetes is not maintaining a Healthy Diet and lack of exercise which leads to Obesity.

Most of us pay taxes to contribute towards the cost of Government and the social utilities that Government administers.  Similarly, we pay fines from various breaches ie. parking, speeding, DUI, late payment of council rates etc.

Society has materially changed its views on many contentious topics and behaviour over recent years.  Car and boat operators can be breathalysed.  Pressure was brought to bear for politicians to be breathalysed following Senator Bartlett swearing and manhandling Liberal Senator Jeannie Ferris in Dec '03 when Senator Bartlett was intoxicated.  Queensland Opposition Leader Lawrence Springborg argued that Ministers in the Queensland Parliament should face random breath tests. 

RailCorp employees, including maintenance staff, are randomly breathalysed.  If you want to climb the Sydney Harbour Bridge you will be breathalysed beforehand. 

In summary, due to the enormous economic malaise predicted in Section 3.II.(a) it is probable that within 20 years Government will -

(A)        require all Australian adults to take a physical annually; and

(B)        impose penalties upon adults who do not Contribution To Society due to maintaining a Negligent Lifestyle Behaviour

Inadequate fiscal coffers will sooner, rather than later, leave Governments no option.
