Recreational Activity means with regard to the Civil Liability Act 2002 which were enacted across Australia in 2002-03 [in the case of NSW) Clause 5M(1) "No duty of care for recreational activity where Risk Warning" of Division 5 Recreational Activities] any of the following if the below activity(ies) involve Obvious Risks:

(a)        Sport (whether or not the sport is an organised activity) which includes sport provided by Sporting Activity Providers.

(b)        Pursuit or activity engaged in for enjoyment, relaxation or leisure.

(c)        pursuit or activity engaged in at a place (such as a beach, park or other public open space) where people ordinarily engage in sport or in any pursuit or activity for enjoyment, relaxation or leisure.
